Terms of service

Golden Planet is a web presence provider for end-users and resellers and is able to help customers with webhosting, online marketing and the development of webservices. Golden Planet works to provide our customers with top-class service, support and know-how in any way possible and is constantly trying to improve in order to help our customers achieve the best possible foundation for their web-based activities. To ensure this Golden Planet has both legal as well as ethical rules that must be adhered to regarding the usage of the services provided.

The ethical rules of Golden planet are specified below. Golden Planet reserves the right to refuse, suspend or discontinue service to anyone at Golden Planet?s sole discretion if we find that any of these rules have been violated.

Availability of services

Golden Planet strives to maximize service availability 24 hours a day, 7 days a week. Experience shows that our servers have a general availability well above 99.9% – the remaining 0.1% downtime is mainly due to planned downtime in connection with security updates. These updates are necessary in order to maintain a high level of security on the servers and are performed at off-peak hours if possible. In the unlikely event that longer periods of unavailability should occur Golden Planet cannot be held liable for any financial losses caused directly on indirectly by the unavailability.

Unauthorized use of accounts and equipment

Golden Planet will take fast and strong action against anyone using or trying to use an account or equipment without proper authorization. This includes (but is not limited to): Scamming (attempting to trick unsuspecting users into providing passwords, credit card numbers etc.), spamming (distributing unwanted mass e-mail), portscanning, network sniffing and attempts to brute-force password cracking.

Any and all unauthorized use of accounts or equipment belonging to Golden Planet or our customers will result in actions spanning from a warning and temporary suspension of service to an immediate cancellation of service and notification of the police or other authorities, depending of the severity of the attack.

Abuse of network and/or diskspace

As a Golden Planet customer you have the privilege to have your service continue temporarily even after your maximum traffic limit has been reached, just like it?s possible to perform an instant upgrade in case your disk space limit has been reached. Please note, however, that we do not allow customers to have huge archives of software for download on our servers, even if the software can be legally distributed this way (e.g. shareware archives). Any customer abusing the rules regarding disk usage and traffic limits will receive an invoice covering the costs connected with the abuse. Any customer reselling diskspace and /or web traffic will receive a warning, have the website suspended or immediately cacelled, depending of the severity of the abuse. If you would like to be a reseller please contact Golden Planet and create a reseller account instead of an ordinary user account.

Commercial advertising via e-mail

Unsolicited commercial e-mail (commonly referred to as ?SPAM?) is not allowed and will result in an immediate termination of your account. Commercial advertising via opt-in mailing lists is allowed but complaints will be investigated and may lead to a warning, suspension or cancellation of your account if Golden Planet finds that the mailing list is being run in an unethical way (e.g that opt-outs are not respected).

Anti-virus and anti-SPAM

Golden Planet maintains a set of anti-virus and anti-SPAM scanners that checks every mail that goes through our mail servers but Golden Planet is unable to guarantee 100% removal of neither virus nor SPAM and cannot be held liable for any damage caused by e-mails that evades the scanners. In the unlikely event that the scanners should cause the entire mail-system to become unstable or unusable Golden Planet reserves the right to disable the scanners entirely, provided that customers are informed by e-mail no later than the moment the scanners are disabled.

Backup

Golden Planet performs a backup procedure once every 24 hours during which a compressed copy of user data is encrypted and moved to a removable storage medium. These media is rotated at least once every month and is moved to a safe offsite location. Access to the backup data (and an automated restore-procedure) is provided through a web based control panel for all our Linux-based webhosting solutions. Manual restore of data beyond the scope of the automated backup may be possible in some cases and will cost a fee of 125 Euro. Golden Planet does not guarantee that data can be restored from the backup media and strongly urge the customer to keep a local backup of important data.

Terms of payment

All accounts and services are installed and activated once advance payment has been received in full unless otherwise agreed upon by both customer and Golden Planet. Installation fees are collected for all new accounts, services and substantial changes and are non-refundable unless specifically stated. All prices are guaranteed at the moment an advance payment is made. Golden Planet reserves the right to change any price at any moment. The customer agrees that until and unless the customer in writing cancels any or all services received, those services will be billed on a recurring basis. Payment by credit card may be done through our payment page with Dankort, VISA-Dankort, VISA, VISA Electron, MasterCard, EuroCard, Maestro or Diners. All payments must be made in Euro unless otherwise agreed upon by both the customer and Golden Planet.

Payments from debtors are used to reduce their debt in the following order: interest – charges – instalments/payment for other services.

In the case of delayed payment for a service or other services owing, the debtor must pay an interest on late payment of 2% per commenced month. The interest on late payment is calculated on the existing remaining debt at any given time, from the time of non-payment that includes interests and costs. The interest accrues monthly (interest on interest). Reminders and claim charges will accrue, cf. the current Interest Act, currently DKK 75.

Golden Planet can unilaterally, and without prior notice, change charge and interest rates pursuant to current legislation.

Money Back Guarantee

If a domain registration or shared hosting service is cancelled within the two first weeks after ordering the service, the customer is eligible for a full refund of the advance payment. Services such as development made specifically for a customer cannot in any circumstances be refunded. Domain registrations must be cancelled immediately after the customer receives an order confirmation as these orders are effectuated right after they are received.

Domain registrations runs for at least one year after the initial registration.

Indemnification

You agree to indemnify, defend, and hold harmless Golden Planet from any and all liability, penalties, losses, damages, costs, expenses, attorneys’ fees, causes of action or claims caused by or resulting indirectly from your use of the service which damages either you, Golden Planet, or any other party or parties without limitation or exception. This indemnification and hold harmless agreement extends to all issues associated with your account, including but not limited to loss of domain name ownership and web site content.

Cancellation and termination of service

Golden Planet reserves the right to cancel any service at any time. Refunds for unused time periods will be provided upon request in the event of account termination. If the account is terminated because of a violation of the terms of use there will be no refunds and additional costs caused by the violation will be invoiced to the customer, due immediately.

Customers are free to cancel services at any time within the current period of payment. Please note that no refunds are made for services with a payment period of 3 months or less ? if the payment period is more than three months the remaining period (only full months) minus three months will be refunded.

Domain registrations MUST be cancelled minimum one month before the domain is due for renewal. Domain registrations and renewals are non-refundable regardless of the payment period.

Due to security reasons we require cancellations to be made in writing, either via ordinary mail or fax. The cancellation must include your full name (optionally company name) and address, a date and a signature. We would also like to know why the service is cancelled but this information is of course optional. If you are cancelling a service for which Golden Planet have provided a username and password you may cancel the service by sending an e-mail including these two items. Please note that redelegating DNS for a domain to other nameservers doesn?t substitute as a cancellation of service with Golden Planet ? all cancellations MUST be done in writing and must be confirmed by Golden Planet.

Cancellations are not valid until you have received a confirmation from Golden Planet via e-mail ? this usually happens within 24 hours on working days. Please contact Golden Planet if you have sent a cancellation and haven?t received a confirmation within three working days. Refunds will be made no less than 15 days after Golden Planet has received a valid bank account number to which the money can be transferred.

Changes in terms of service

Current prices and terms of services are always shown on our webpage (https://www.goldenplanet.com). Current customers will receive and advance warning three months ahead of any changes in pricing. The date for changes in the terms of service will be stated in your invoice together with a link to the changed terms of service. By paying the invoice you accept the new terms of service.

VAT

Golden Planet primarily provides services to business-to-business customers and as such states all prices excluding 25% Danish VAT unless otherwise stated. Payment of VAT may not apply to companies outside Denmark.

Acceptable use policy

Golden Planet reserves the right to refuse or discontinue service to anyone at Golden Planet?s sole discretion. Customers are only allowed to use the services provided by Golden Planet for lawful purposes. Golden Planet strictly prohibits that any provided services are used to promote, distribute, store, process or in any other way handle indecent or satanic material. Hosting of adult content (including but not limited to pornography and erotic content) requires that the customer obtain permission from Golden Planet (in writing) to do so prior to publishing the content.

You agree not to maliciously or intentionally interfere with the proper operation of Golden Planet’s systems, including but not limited to defeating identification procedures, obtaining access beyond that which you are authorized for, and impairing the availability, reliability, or quality of service for other customers. This includes running scripts and/or applications that uses large amounts of system resources (e.g. memory, CPU, network capacity). You further agree not to interfere with the proper operation of other systems reachable through the Internet, including any attempt at unauthorized access.

Golden Planet may deny you access to all or part of the service without notice if you engage in any conduct or activities that Golden Planet in its sole discretion believes violates any of the terms and conditions in this agreement.

Registration of domain names

When registering domain names you accept the conditions from the registrators/administrator. They are available here:

Additional terms and conditions for resellers

Golden Planet reserves the right to move end-users from one reseller to another should the customer specifically request it. This may be done without the accept of the losing reseller if at least one of the following two criterias are met: The reseller has not responded to several attempts to communicate either via e-mail or telephone, or the reseller is merely blocking the transfer and unable to supply a valid reason for doing so. The end-user must request the move in writing in these cases.
